In this document, the Wireless Telecommunications Bureau (WTB) of the Federal Communications Commission (Commission) amends the part 97 Amateur Radio Service rules to clarify certain rules and codifies existing procedures governing the amateur service vanity call sign system. The Commission also revises certain rules applicable to amateur service club stations. The Commission found that certain provisions in the rules applicable to the vanity call sign system should be codified in our rules, and others added, so that the vanity call sign PO 00000 Frm 00011 Fmt 4702 Sfmt 4702 system will be fair, equitable, and transparent to all amateur service licensees. Specifically, the Commission proposes in the NPRM to amend the amateur service’s vanity call sign rules to: clarify the process by which such call signs become available for reassignment after the license expires or is canceled; clarify the exceptions to the rule that a call sign shown on a canceled license is unavailable to the vanity call sign system for two years; require that applications requesting a change in trustee include documentation signed by an officer of the club when the application is submitted to the Club Station Call Sign Administrator; and, to limit club stations to holding one call sign. I. Procedural Matters A. Ex Parte Rules—Permit-but-Disclose Proceeding 2. This is a permit-but-disclose notice and comment rulemaking proceeding. Ex parte presentations are permitted, except during the Sunshine Agenda period, provided they are disclosed as provided in the Commission’s rules. B. Comment Dates 3. Pursuant to sections 1.415 and 1.419 of the Commission’s rules, interested parties may file comments on or before March 26, 2010, and reply comments are due April 12, 2010. 4.
