at OAK, Oakland, Alameda County,
California. The proposed airport
connector project would operate on an
Automated Guideway Transit (AGT)
system on an exclusive, approximate 3mile long right-of-way. The AGT would
provide a link between the existing
BART Coliseum station and the airport
terminal. Approximately one mile of the
connector project would be built on
airport property. The connector project
would improve access to OAK by using
a direct and convenient connection to
the existing regional BART rail transit
system. The ROD discusses alternatives
considered by FAA in reaching its
decision, summarizes the analysis used
to evaluate the alternatives, and briefly
summarizes the potential environmental
consequences evaluated in the FAA’s
ROD. The ROD also identifies the FAA’s
environmentally preferred alternative,
applicable and required mitigation. The
FAA submitted a letter to the U.S.
Environmental Protection Agency (EPA)
on November 19, 2009, indicating the
FAA was adopting the Federal Transit
Administration (FTA) 2002 FEIS on this
project and also re-circulated the EIS as
a Final EIS for the FAA. EPA published
the notice indicating FAA’s adoption of
the FTA FEIS in the Federal Register on
November 27, 2009. The comment
period closed on December 28, 2009 and
comments were received from the EPA.
The FAA provided responses to the EPA
comments in Appendix A of the ROD.

Requested Administrative Waiver of
the Coastwise Trade Laws
AGENCY: Maritime Administration,
Department of Transportation.
ACTION: Invitation for public comments
on a requested administrative waiver of
the Coastwise Trade Laws for the vessel
CYTHERA.
SUMMARY: As authorized by 46 U.S.C.
12121, the Secretary of Transportation,
as represented by the Maritime
Administration (MARAD), is authorized
to grant waivers of the U.S.-build
requirement of the coastwise laws under
certain circumstances. A request for
such a waiver has been received by
MARAD. The vessel, and a brief
description of the proposed service, is
listed below. The complete application
is given in DOT docket MARAD–2010–
0003 at https://www.regulations.gov.
Interested parties may comment on the
effect this action may have on U.S.
vessel builders or businesses in the U.S.
that use U.S.-flag vessels. If MARAD
determines, in accordance with 46
U.S.C. 12121 and MARAD’s regulations
at 46 CFR part 388 (68 FR 23084; April
30, 2003), that the issuance of the
waiver will have an unduly adverse
effect on a U.S.-vessel builder or a
business that uses U.S.-flag vessels in
that business, a waiver will not be
granted. Comments should refer to the
docket number of this notice and the
vessel name in order for MARAD to
properly consider the comments.
Comments should also state the
commenter’s interest in the waiver
