SUPPLEMENTARY INFORMATION: Notice is hereby given that, in a letter dated December 16, 2009, the President issued a major disaster declaration under the authority of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. 5121 et seq. (the ‘‘Stafford Act’’), as follows: I have determined that the damage in certain areas of the State of Nebraska resulting from a severe winter storm during the period of November 16–17, 2009, is of sufficient severity and magnitude to warrant a major disaster declaration under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. 5121 et seq. (the ‘‘Stafford Act’’). Therefore, I declare that such a major disaster exists in the State of Nebraska. In order to provide Federal assistance, you are hereby authorized to allocate from funds available for these purposes such amounts as you find necessary for Federal disaster assistance and administrative expenses. You are authorized to provide Public Assistance in the designated areas and Hazard Mitigation throughout the State. Consistent with the requirement that Federal assistance is supplemental, any Federal funds provided under the Stafford Act for Public Assistance and Hazard Mitigation will be limited to 75 percent of the total eligible costs. Further, you are authorized to make changes to this declaration for the approved assistance to the extent allowable under the Stafford Act. SUPPLEMENTARY INFORMATION: Background The U.S. Customs and Border Protection Airport and Seaport Inspections User Fee Advisory Committee was established as an advisory committee in accordance with the provisions of the Federal Advisory Committee Act (FACA), 5 U.S.C. App. This Advisory Committee was originally established pursuant to section 286(k) of the Immigration and Nationality Act (INA), codified at title 8 U.S.C. 1356(k), which references the Federal Advisory Committee Act (5 U.S.C. App.). With the merger of the Immigration and Naturalization Service into the U.S. Department of Homeland Security (DHS), the Advisory Committee’s responsibilities were transferred from the Attorney General to the Commissioner of U.S. Customs and Border Protection (CBP) pursuant to section 1512(d) of the Homeland Security Act of 2002. The Committee Purpose and Objective: The purpose of the Committee is to provide advice to the Commissioner of CBP and the Secretary of DHS on issues related to the performance of airport and seaport inspections involving agriculture, customs, and immigration concerns on a regular basis in an open and candid atmosphere.
