ACTION: Direct final rule. SUMMARY: EPA is taking direct final action to approve a revision to the Monterey Bay Area portion of the California State Implementation Plan. Submitted by the California Air Resources Board on December 19, 2007, this plan revision consists of a maintenance plan prepared for the purpose of providing for continued attainment of the 8-hour ozone standard in Monterey Bay through the year 2014 and thereby satisfying the related requirements under Section 110(a)(1) of the Clean Air Act and EPA’s phase 1 rule implementing the 8-hour ozone national ambient air quality standard. EPA is taking this action pursuant to those provisions of the Clean Air Act that obligate the Agency to take action on submittals of state implementation plans and plan revisions. DATES: This rule is effective February 16, 2010 without further notice, unless EPA receives relevant adverse comment by January 19, 2010. If EPA receives such comment, EPA will publish a timely withdrawal in the Federal Register informing the public that this rule will not take effect. SUMMARY: The Commander, First Coast Guard District, has issued a 
temporary deviation from the regulation governing the operation of the 
Beach Channel Railroad Bridge at mile 6.7, across Jamaica Bay, at New 
York City, New York. Under this temporary deviation the Beach Channel 
Railroad Bridge may remain in the closed position for two weekends in 
December. This deviation is necessary to facilitate bridge maintenance 
repairs.

DATES: This deviation is effective from 12:15 a.m. on December 12, 2009 
through 4:45 a.m. on December 21, 2009. It is necessary to repair the
