This final rule directly regulates growers, food processors, food handlers, and food retailers, not States or tribes, nor does this action alter the relationships or distribution of power and responsibilities established by Congress in the preemption provisions of section 408(n)(4) of FFDCA. As such, the Agency has determined that this action will not have a substantial direct effect on States or tribal governments, on the relationship between the national government and the States or tribal governments, or on the distribution of power and responsibilities among the various levels of government or between the Federal Government and Indian tribes. In addition, this final rule does not impose any enforceable duty or contain any unfunded mandate as described under Title II of the Unfunded Mandates Reform Act of 1995 (UMRA) (Public Law 104–4). ACTION: Correcting amendment.

SUMMARY: The Federal Communications Commission (FCC) is correcting 
final rules affecting the conversion to digital television that were 
published in the Federal Register at 73 FR 5634, January 30, 2008, 
which were inadvertently omitted from the rules in the Federal 
Register.

DATES: Effective December 2, 2009.

SUPPLEMENTARY INFORMATION: The Commission's Report and Order in MB

However, the revision to Sec.  15.120(b) to change the words ``in 
diameter'' to ``measured diagonally'' was inadvertently omitted from 
the rules appendix of the Federal Register summary document, 73 FR 
5634, published January 30, 2008. With this document, the Commission 
amends its rules by revising Sec.  15.120(b) as was intended.
