E9–28128 Filed 11–23–09; 8:45 am] BILLING CODE 8025–01–P COMMODITY FUTURES TRADING COMMISSION SECURITIES AND EXCHANGE COMMISSION [Release No. 34–61027] Joint Order Modifying the Listing Standards Requirements Under Section 6(h) of the Securities Exchange Act of 1934 and the Criteria Under Section 2(a)(1) of the Commodity Exchange Act The Securities Exchange Act of 1934 (‘‘Exchange Act’’) and the Commodity Exchange Act (‘‘CEA’’) set forth the types of securities on which security futures 1 can be based. The Exchange Act provides that it is unlawful for any person to effect transactions in security futures that are not listed on a national securities exchange or a national securities association registered pursuant to Section 15A of the Exchange Act.2 The Exchange Act further provides that such exchange or association is permitted to trade only security futures that conform with listing standards filed with the Securities and Exchange Commission (‘‘SEC’’) and that meet the criteria specified in Section 2(a)(1)(D)(i) of the CEA.3 Section 2(a)(1)(D)(i) of the CEA permits the Commodity Futures Trading Commission (‘‘CFTC’’) to designate a board of trade as a contract market with respect to, or to register as a derivatives transaction execution facility to list or execute, transactions in security futures if the board of trade and the applicable contract meet the criteria specified in that section. Similarly, the Exchange Act requires that the listing standards filed with the SEC by an exchange or 1 Security futures are futures contracts on single securities and narrow-based security indexes.
