On the basis of the record 1 developed
in the subject investigations, the United
States International Trade Commission
(Commission) determines, pursuant to
sections 703(a) and 733(a) of the Tariff
Act of 1930 (19 U.S.C. 1671b(a) and
1673b(a)) (the Act), that there is no
reasonable indication that an industry
in the United States is materially
injured or threatened with material
injury, or that the establishment of an
industry in the United States is
materially retarded, by reason of
imports from China and Taiwan of
certain standard steel fasteners
(‘‘CSSF’’), provided for in subheadings
7318.15.20, 7318.15.80, and 7318.16.00
of the Harmonized Tariff Schedule of
the United States. CSSF imported from
China are alleged to be subsidized and
sold in the United States at less than fair
value (LTFV). CSSF imported from
Taiwan are alleged to be sold in the
United States at LTFV.
Background
On September 23, 2009, petitions
were filed with the Commission and
Commerce by Nucor Fastener Division,
St. Joe, Indiana, alleging that an
industry in the United States is
materially injured and threatened with
material injury by reason of LTFV and
subsidized imports of CSSF from China
and LTFV imports of CSSF from
Taiwan. Accordingly, effective
September 23, 2009, the Commission
instituted countervailing duty
investigation No. 701–TA–472 and
antidumping duty investigations Nos.
731–TA–1171–1172 (Preliminary).
Notice of the institution of the
Commission’s investigations and of a
public conference to be held in
connection therewith was given by
posting copies of the notice in the Office
of the Secretary, U.S. International
Trade Commission, Washington, DC,
and by publishing the notice in the

SUPPLEMENTARY INFORMATION: The
Commission instituted this investigation
on March 4, 2008, based on a complaint
filed by Sharp Corporation (‘‘Sharp’’) of
Japan. 73 FR 11678. The complaint, as
amended and supplemented, alleges
violations of section 337 of the Tariff
Act of 1930, as amended, 19 U.S.C.
1337, in the importation into the United
States, the sale for importation, and the
sale within the United States after
importation of certain liquid crystal
display devices, products containing
same, and methods for using the same
by reason of infringement of certain
claims of U.S. Patent Nos. 6,879,364
(‘‘the ’364 patent’’); 6,952,192 (‘‘the ’192
patent’’); 7,304,703 (‘‘the ’703 patent’’);
and 7,304,626 (‘‘the ’626 patent’’). The
complaint further alleges the existence
of a domestic industry. The
Commission’s notice of investigation
named the following respondents:
Samsung Electronics Co., Ltd. of Korea;
Samsung Electronics America, Inc. of
Ridgefield Park, New Jersey; and
Samsung Semiconductor, Inc. of San
Jose, California (collectively,
‘‘Samsung’’).
On June 12, 2009, the ALJ issued his
final ID finding a violation of section
337 by Samsung. He also issued his
recommendation on remedy and
bonding during the period of
Presidential review. On June 29, 2009,
Samsung and the Commission
investigative attorney (‘‘IA’’) filed
petitions for review of the final ID. The
IA and Sharp filed responses to the
petitions on July 7, 2009. On September
9, 2009, the Commission issued notice
of its determination not to review the
ALJ’s final ID and requested written
submissions on the issues of remedy,
the public interest, and bonding from
the parties and interested non-parties.

respectively, complainant Sharp, the
Samsung respondents, and the IA filed
briefs and reply briefs on the issues for
