ACTION: Final rule.
SUMMARY: The Audio Division grants a
Petition for Rule Making issued at the
request of William S. Konopnicki,
proposing the allotment of Channel
249C1 at McNary, Arizona, as its first
local service. Channel 249C1 at McNary
can be allotted, consistent with the
minimum distance separation
requirements of the Commission’s Rules
(the ‘‘Rules) with the imposition of a
site restriction located 0.3 kilometers
(0.2 miles) northeast of the community,
using reference coordinates 34–04–30
NL and 109–51–15 WL. The McNary
allotment is contingent upon the final
outcome of MB Docket No. 05–263 since
the proposed allotment is short–spaced
to counter–proposed Channel 251C at
St. Johns, Arizona in that proceeding.

SUMMARY: NMFS issues regulations
implementing Amendment 85 to the
Fishery Management Plan for
Groundfish of the Gulf of Alaska. These
regulations amend the Central Gulf of
Alaska Rockfish Program to remove a
restriction that prohibits certain catcher/
processors from participating in
directed groundfish fisheries in the
Bering Sea and Aleutian Islands
Management Area in July. This action is
necessary to improve flexibility and
reduce operating costs for catcher/
processors that participate in the Central
Gulf of Alaska Rockfish Program. This
action is intended to promote the goals
and objectives of the Magnuson-Stevens
Fishery Conservation and Management
Act, the Fishery Management Plan for
Groundfish of the Gulf of Alaska, and
other applicable laws.
DATES: Effective December 3, 2009.
