76.1710 requires cable operators to
maintain records in their public file for
a period of three years regarding the
nature and extent of their attributable
interests in all video programming
services. The records must be made
available to members of the public, local
franchising authorities and the
Commission on reasonable notice and
during regular business hours. The
records will be reviewed by local
franchising authorities and the
Commission to monitor compliance
with channel occupancy limits in
respective local franchise areas.

The FCC Sunshine Notice dated 10–
15–09 inadvertently failed to include
the following language: The
Commission waives the Sunshine
Period Prohibition on ex parte contacts
with the Commission to the extent that
those contacts are made through the
Open Internet Blog, https://
blog.openinternet.gov. Such contacts
take place in a forum that is both
instantaneously available to all
interested parties and will not intrude
on the Commission’s decision making.
