SUPPLEMENTARY INFORMATION: A notice
of proposed rulemaking and a notice of
public hearing that appeared in the
Federal Register on Tuesday, July 28,
2009 (74 FR 37183) announced that a
public hearing was scheduled for
November 20, 2009, at 10 a.m. in the
IRS Auditorium, Internal Revenue
Building, 1111 Constitution Avenue,
NW., Washington, DC. The subject of
the public hearing is under Circular 230
of the Internal Revenue Code.
The public comment period for these
regulations expired on September 10,
2009. Outlines of topics to be discussed
at the hearing were due on September
10, 2009. The notice of proposed

change the drawbridge operation
regulations of the S213 Bridge, at mile
26.8, across Chester River at
Chestertown MD. This proposal would
allow the bridge to open on signal if at
least six hours notice is given and
would provide for the reasonable needs
of navigation, due to the anticipated
infrequency of requests for vessel
openings of the drawbridge.

Background and Purpose
Maryland Department of
Transportation-State Highway
Administration (MDOT) is responsible
for the operation of the S213 Bridge, at
mile 26.8, across Chester River at
Chestertown MD. MDOT requested
advance notification for vessel openings
year-round due to the anticipated
infrequency of requests for vessel
openings of the drawbridge.
The S213 Bridge has a vertical
clearance in the closed position to
vessels of 12 feet, above mean high
water.
