After consideration of all relevant
matter presented, including the
information and recommendation
submitted by the Committee and other
available information, it is hereby found
that this rule, as hereinafter set forth,
will tend to effectuate the declared
policy of the Act.
Pursuant to 5 U.S.C. 553, it also found
and determined that good cause exists
for not postponing the effective date of
this rule until 30 days after publication
in the Federal Register because
handlers are already shipping prunes
from the 2009–10 crop and the
Committee needs to have sufficient
funds to pay its expenses, which are
incurred on a continuous basis. Further,
handlers are aware of this action, which
was recommended by the Committee at
a public meeting and is similar to other
assessment rate actions issued in past
years. Finally, a 30-day comment period
was provided for in the proposed rule.

The FAA uses the direct final
rulemaking procedure for a noncontroversial rule where the FAA
believes that there will be no adverse
public comment. This direct final rule
advised the public that no adverse
comments were anticipated, and that
unless a written adverse comment, or a
written notice of intent to submit such
an adverse comment, were received
within the comment period, the
regulation would become effective on
March 12, 2009. No adverse comments
were received, and thus this notice
confirms that effective date.

Airspace Docket No. 08–ANM–1, FAA
Docket No. FAA–2008–0006 was
published in the Federal Register (74
FR 43030), establishing Class D airspace
and amending Class E airspace at North
Bend, OR. The latitude, longitude
referencing the airport stated ‘‘* * * lat.
43°25′02″ N., long. 124°14′46″ W.’’
instead of ‘‘* * * lat. 43°25′01″ N., long.
124°14′49″ W.’’. Also the airport name
stated ‘‘North Bend Municipal Airport,
OR’’ instead of ‘‘Southwest Oregon
Regional Airport, OR’’. This action
corrects that error.
