E. Factor 4: Remaining Useful Life of
Facility
1. FCPP
The remaining useful life of the
facility is often expressed in terms of the
amortization period used to annualize
the costs of control. In its analysis, APS
used an amortization period of 20 years,
anticipating that the remaining useful
life of Units 1–5 is at least 20 years.
EPA is requesting comment on the use
of this period of time for the remaining
useful life of FCPP.
2. NGS
In its analysis, SRP used an
amortization period of 20 years,
anticipating that the remaining useful
life of Units 1–3 is at least 20 years.
EPA is also requesting comment on
the use of this period of time for the
remaining useful life of NGS.

III. Statutory and Executive Order
Reviews
Under Executive Order 12866,
entitled Regulatory Planning and
Review (58 FR 51735, October 4, 1993),
this is not a ‘‘significant regulatory
action.’’ Because this action does not
propose or impose any requirements,
the various statutes and Executive
Orders that apply to rulemaking do not
apply in this case. In addition, this
notice covers two facilities. Any future
rulemaking would be separate, one for
each facility. Determinations of
significance and applicability of any
Executive Order or statute would
depend upon the content of each
individual rulemaking. Should EPA
subsequently determine to pursue
rulemaking and propose BART for these
facilities, EPA will address the statutes
and Executive Orders as applicable to
those individual proposed actions.
Nevertheless, the Agency welcomes
comments and/or information that
would help the Agency to assess any of
the following: tribal implications
pursuant to Executive Order 13175,
entitled Consultation and Coordination
with Indian Tribal Governments (65 FR
67249, November 6, 2000);
environmental health or safety effects
on children pursuant to Executive Order
13045, entitled Protection of Children
29 On November 20, 2008, EPA Region IX issued
a PSD permit authorizing NGS to modify Units 1–
3 with LNB + SOFA over 2009–2011.

from Environmental Health Risks and
Safety Risks (62 FR 19885, April 23,

Executive Order 13211, entitled Actions
Concerning Regulations that
Significantly Affect Energy Supply,
Distribution, or Use (66 FR 28355, May
22, 2001); Paperwork burdens pursuant
to the Paperwork Reduction Act (PRA)

Executive Order 12898, entitled Federal

Justice in Minority Populations and
Low-Income Populations (59 FR 7629,

consider such comments during the
development of any subsequent
rulemaking.

This
proposal addresses the following local
rules: SJVUAPCD Rule 1020, Definitions
and SBCAPCD Rule 102, Definitions. In
the Rules and Regulations section of this
Federal Register, we are approving
these local rules in a direct final action
without prior proposal because we
believe these SIP revisions are not
controversial. If we receive adverse
comments, however, we will publish a
timely withdrawal of the direct final
rule and address the comments in
subsequent action based on this
proposed rule. Please note that if we
receive adverse comment on an
amendment, paragraph, or section of
this rule and if that provision may be
severed from the remainder of the rule,
we may adopt as final those provisions
of the rule that are not the subject of an
adverse comment.
We do not plan to open a second
comment period, so anyone interested
in commenting should do so at this
time. If we do not receive adverse
comments, no further activity is
planned. For further information, please
see the direct final action.
