Energy Effects
We have analyzed this rule under
Executive Order 13211, Actions
Concerning Regulations That
Significantly Affect Energy Supply,
Distribution, or Use. We have
determined that it is not a ‘‘significant
energy action’’ under that order because
it is not a ‘‘significant regulatory action’’
under Executive Order 12866 and is not
likely to have a significant adverse effect
on the supply, distribution, or use of
energy. The Administrator of the Office
of Information and Regulatory Affairs
has not designated it as a significant
energy action. Therefore, it does not
require a Statement of Energy Effects
under Executive Order 13211.
Technical Standards
The National Technology Transfer
and Advancement Act (NTTAA) (15
U.S.C. 272 note) directs agencies to use
voluntary consensus standards in their
regulatory activities unless the agency
provides Congress, through the Office of
Management and Budget, with an
explanation of why using these
standards would be inconsistent with
applicable law or otherwise impractical.
Voluntary consensus standards are
technical standards (e.g., specifications
of materials, performance, design, or
operation; test methods; sampling
procedures; and related management
systems practices) that are developed or

This rule does not use technical
standards. Therefore, we did not
consider the use of voluntary consensus

Environment
We have analyzed this rule under
Department of Homeland Security
Management Directive 023–01 and
Commandant Instruction M16475.lD,
which guide the Coast Guard in
complying with the National
Environmental Policy Act of 1969
(NEPA) (42 U.S.C. 4321–4370f), and
have concluded this action is one of a
category of actions which do not
individually or cumulatively have a
significant effect on the human
environment. This rule is categorically
excluded, under figure 2–1, paragraph
(34)(g), of the Instruction. This rule
involves establishing a safety zone
around a fireworks display. Under
figure 2–1, paragraph (34)(g), of the
Instruction, an environmental analysis
checklist and a categorical exclusion
determination are not required for this
rule.

preamble, the Coast Guard amends 33
CFR part 165 as follows:

prohibited unless authorized by the
Captain of the Port, Hampton Roads or

immediate vicinity of this safety zone
shall:
(i) Stop the vessel immediately upon
being directed to do so by any
commissioned, warrant or petty officer
on shore or on board a vessel that is
displaying a U.S. Coast Guard Ensign.
(ii) Proceed as directed by any
commissioned, warrant or petty officer
on shore or on board a vessel that is
displaying a U.S. Coast Guard Ensign.
(3) The Captain of the Port, Hampton
Roads can be reached through the Sector
Duty Officer at Sector Hampton Roads
in Portsmouth, Virginia at telephone
Number (757) 668–5555.
(4) The Coast Guard Representatives
enforcing the safety zone can be
contacted on VHF–FM marine band
radio channel 13 (165.65Mhz) and
channel 16 (156.8 Mhz).
(d) Effective period. This regulation
will be in effect on July 2, July 3, August
21, September 3, and September 4, 2009
from 9 p.m. until 10:30 p.m.

165.20, entry into, transiting, or
anchoring within these safety zones is
prohibited unless authorized by the
Captain of the Port Detroit or his
designated representative. Vessels that
wish to transit through the safety zones
may request permission from the
Captain of the Port Detroit. Requests
must be made in advance and approved
by the Captain of the Port before transits
will be authorized. Approvals will be
granted on a case by case basis. The
Captain of the Port may be contacted via
U.S. Coast Guard Sector Detroit on
channel 16, VHF–FM. The Coast Guard
will give notice to the public via a
Broadcast to Mariners that the
regulation is in effect.
This notice is issued under authority
of 33 CFR 165.20 and 5 U.S.C. 552(a).
If the District Commander, Captain of
the Port, or other official authorized to
do so, determines that the regulated area
need not be enforced for the full
duration stated in this notice, he or she
may use a Broadcast Notice to Mariners
to grant general permission to enter the
safety zone.

ACTION: Direct final notice of deletion of
the Central Wood Preserving Company
Superfund Site from the National
Priorities List.
SUMMARY: The Environmental Protection
Agency (EPA) region 6 is publishing a
direct final notice of deletion of the
Central Wood Preserving Company
Superfund Site (Site), located in East
Feliciana Parish, Louisiana, from the
National Priorities List (NPL). The NPL,
promulgated pursuant to section 105 of
the Comprehensive Environmental
Response, Compensation, and Liability
Act (CERCLA) of 1980, as amended, is
an appendix of the National Oil and
Hazardous Substances Pollution
Contingency Plan (NCP). This direct
final deletion is being published by EPA
with the concurrence of the State of
Louisiana; through the Louisiana
Department of Environmental Quality
because EPA has determined that all
appropriate response actions under
CERCLA have been completed.
However, this deletion does not
preclude future actions under
Superfund.
DATES: This direct final deletion will be
effective September 18, 2009 unless
EPA receives adverse comments by
August 19, 2009. If adverse comments
are received, EPA will publish a timely
withdrawal of the direct final deletion
in the Federal Register informing the
public that the deletion will not take
effect.

Under the provisions of 33 CFR 165.20, entry into, transiting, or
anchoring within these safety zones is prohibited unless authorized by
the Captain of the Port Detroit or his designated representative.
Vessels that wish to transit through the safety zones may request
permission from the Captain of the Port Detroit. Requests must be made
in advance and approved by the Captain of the Port before transits will
be authorized. Approvals will be granted on a case by case basis. The
Captain of the Port may be contacted via U.S. Coast Guard Sector
Detroit on channel 16, VHF-FM. The Coast Guard will give notice to the
public via a Broadcast to Mariners that the regulation is in effect.
This notice is issued under authority of 33 CFR 165.20 and 5 U.S.C.
552(a). If the District Commander, Captain of the Port, or other
official authorized to do so, determines that the regulated area need
not be enforced for the full duration stated in this notice, he or she
may use a Broadcast Notice to Mariners to grant general permission to
enter the safety zone.
