Take notice that on June 29, 2009, the
Louisiana Public Service Commission
filed a formal complaint against Entergy
Corp., Entergy Services, Inc., Entergy
Louisiana, LLC, Entergy Arkansas, Inc.,
Entergy Mississippi, Inc., Entergy New
Orleans, Inc., Entergy Texas, Inc., and
Entergy Gulf States Louisiana, LLC,
pursuant to section 206 of the Federal
Power Act, 16 U.S.C. 824e and 18 CFR
386.206, alleging that sales of electric
energy by Entergy Arkansas, Inc. to
third party power marketers and others
that are not members of the Entergy
System Agreement (System Agreement):
(a) Violated the provisions of the System
Agreement that allocate the energy
generated by System resources, (b)
imprudently denied the System and its
ultimate consumers the benefits of lowcost System generating capacity, and (c)
violated the provisions of the System
Agreement that prohibits sales to third
parties by individual companies absent
an offer of a Right-of-First-Refusal to the
other companies.
The Louisiana Public Service
Commission certifies that copies of the
complaint were served on the contacts
for Entergy Corp., Entergy Services, Inc.,
Entergy Louisiana, LLC, Entergy
Arkansas, Inc., Entergy Mississippi, Inc.,
Entergy New Orleans, Inc., Entergy
Texas, Inc., and Entergy Gulf States
Louisiana, LLC, as listed on the
Commission’s list of Corporate Officials.
Any person desiring to intervene or to
protest this filing must file in
accordance with Rules 211 and 214 of
the Commission’s Rules of Practice and
Procedure (18 CFR 385.211, 385.214).
