n. Any qualified applicant desiring to
file a competing application must
submit to the Commission, on or before
the specified intervention deadline date,
a competing development application,
or a notice of intent to file such an
application. Submission of a timely
notice of intent allows an interested
person to file the competing
development application no later than
120 days after the specified intervention
deadline date. Applications for
preliminary permits will not be
accepted in response to this notice.
A notice of intent must specify the
exact name, business address, and
telephone number of the prospective
applicant, and must include an
unequivocal statement of intent to
submit a development application. A
notice of intent must be served on the
applicant(s) named in this public notice.
Anyone may submit a protest or a
motion to intervene in accordance with
the requirements of Rules of Practice
and Procedure, 18 CFR 385.210,
385.211, and 385.214. In determining
the appropriate action to take, the
Commission will consider all protests
filed, but only those who file a motion
to intervene in accordance with the
Commission’s Rules may become a
party to the proceeding. Any protests or
motions to intervene must be received
on or before the specified deadline date
for the particular application.
When the application is ready for
environmental analysis, the
Commission will issue a public notice
requesting comments,
recommendations, terms and
conditions, or prescriptions.
All filings must (1) bear in all capital
letters the title ‘‘PROTEST’’ or
‘‘MOTION TO INTERVENE,’’ ‘‘NOTICE
OF INTENT TO FILE COMPETING
APPLICATION,’’ or ‘‘COMPETING
APPLICATION;’’ (2) set forth in the
heading the name of the applicant and
the project number of the application to
which the filing responds; (3) furnish
the name, address, and telephone
number of the person protesting or
intervening; and (4) otherwise comply
with the requirements of 18 CFR

Augusta Canal Authority; Notice of
Authorization for Continued Project
Operation
June 4, 2009.
On May 30, 2007, Augusta Canal
Authority, licensee for the King Mill
Hydroelectric Project, filed an
Application for a New License pursuant
to the Federal Power Act (FPA) and the
Commission’s regulations thereunder.
The King Mill Hydroelectric Project is
located on the Augusta Canal, adjacent
to the Savannah River, in Richmond
County, Augusta, GA.
The license for Project No. 9988 was
issued for a period ending May 31,
2009. Section 15(a)(1) of the FPA, 16
U.S.C. 808(a)(1), requires the
Commission, at the expiration of a
license term, to issue from year-to-year
an annual license to the then licensee
under the terms and conditions of the
prior license until a new license is
issued, or the project is otherwise
disposed of as provided in section 15 or
any other applicable section of the FPA.
If the project’s prior license waived the
applicability of section 15 of the FPA,
then, based on section 9(b) of the
Administrative Procedure Act, 5 U.S.C.
558(c), and as set forth at 18 CFR
16.21(a), if the licensee of such project
has filed an application for a subsequent
license, the licensee may continue to
operate the project in accordance with
the terms and conditions of the license
after the minor or minor part license
expires, until the Commission acts on
its application. If the licensee of such a
project has not filed an application for
a subsequent license, then it may be
required, pursuant to 18 CFR 16.21(b),
to continue project operations until the
Commission issues someone else a
license for the project or otherwise
orders disposition of the project.
If the project is subject to section 15
of the FPA, notice is hereby given that
an annual license for Project No. 9988

for a period effective June 1, 2009
through May 31, 2010, or until the
issuance of a new license for the project
or other disposition under the FPA,
whichever comes first. If issuance of a
new license (or other disposition) does
not take place on or before May 31,
2010, notice is hereby given that,
pursuant to 18 CFR 16.18(c), an annual
license under section 15(a)(1) of the
FPA is renewed automatically without
further order or notice by the
Commission, unless the Commission
orders otherwise. If the project is not
subject to section 15 of the FPA, notice
is hereby given that the Augusta Canal
Authority is authorized to continue
operation of the King Mill Hydroelectric
Project, until such time as the
Commission acts on its application for
a subsequent license.
