State, Foreign Operations, and Related
Programs Appropriations Act, 2009

We are
soliciting public comments to permit
the Department to:
Evaluate whether the proposed
collection of information is necessary
for the proper performance of our
functions.
Evaluate the accuracy of our estimate
of the burden of the proposed
collection, including the validity of the
methodology and assumptions used.
Enhance the quality, utility, and
clarity of the information to be
collected.
Minimize the reporting burden on
those who are to respond, including the
use of automated collection techniques
or other forms of technology.
Abstract of proposed collection: Form
DS–6001 is used when an exporter
desires an opinion as to whether the
Directorate of Defense Trade Controls
would likely grant a license or other
approval for a particular export
transaction involving defense articles or
defense services. Also, the DS–6001
may be used to satisfy the prior
approval requirements of 22 CFR 126.8
for a proposal to sell or manufacture
abroad significant military equipment to
foreign persons.
Methodology: This information
collection may be sent to the Directorate
of Defense Controls via mail.

as Secretary of State, including under
section 7072(c) of the Department of
State, Foreign Operations, and Related
Programs Appropriations Act (SFOAA),
2009 (Div. H, Pub. L. 111–8), and the
President’s Delegation of
Responsibilities Related to the Federal
Republic of Yugoslavia, dated March 22,
2001, I hereby determine and certify
that the Government of Serbia is:
(1) Cooperating with the International
Criminal Tribunal for the former
Yugoslavia including access for
investigators, the provision of
documents, timely information on the
location, movement, and sources of
financial support of indictees, and the
surrender and transfer of indictees or
assistance in their apprehension,
including Ratko Mladic;
(2) taking steps that are consistent
with the Dayton Accords to end Serbian
financial, political, security, and other
support which has served to maintain
separate Republika Srpska institutions;
and
(3) taking steps to implement policies
which reflect a respect for minority
rights and the rule of law.
This Determination and related
Memorandum of Justification shall be
provided to the appropriate committees
of the Congress. This Determination
shall be published in the Federal
Register.

as represented by the Maritime
Administration (MARAD), is authorized
to grant waivers of the U.S.-build
requirement of the coastwise laws under
certain circumstances. A request for
such a waiver has been received by
MARAD. The vessel, and a brief
description of the proposed service, is
listed below. The complete application
is given in DOT docket MARAD–2009–
0058 at https://www.regulations.gov.
Interested parties may comment on the
effect this action may have on U.S.
vessel builders or businesses in the U.S.
that use U.S.-flag vessels. If MARAD
determines, in accordance with 46
U.S.C. 12121 and MARAD’s regulations
at 46 CFR Part 388 (68 FR 23084; April
30, 2003), that the issuance of the
waiver will have an unduly adverse
effect on a U.S.-vessel builder or a
business that uses U.S.-flag vessels in
that business, a waiver will not be
granted. Comments should refer to the
docket number of this notice and the
vessel name in order for MARAD to
properly consider the comments.
Comments should also state the
commenter’s interest in the waiver
application, and address the waiver
criteria given in § 388.4 of MARAD’s
regulations at 46 CFR Part 388.
