informal consultation with: (a) The U.S.
Fish and Wildlife Service under section
7 of the Endangered Species Act and the
joint agency regulations thereunder at
50 CFR, Part 402; and (b) the Utah State
Historic Preservation Officer, as
required by section 106, National
Historic Preservation Act, and the
implementing regulations of the
Advisory Council on Historic
Preservation at 36 CFR 800.2.

complaint against ISO New England Inc.
(Respondent) as an appeal of the
Respondent’s denial of Complainant’s
Requested Billing Adjustment on
February 20, 2009, which relates to the
Respondent’s revocation of
Complainant’s June 2008 Installed
Capacity Payments.
The Complainant certifies that a copy

Office of Energy Projects has reviewed
the application for a subsequent license
for the 1.14-megawatt Glendale
Hydroelectric Project, located on the
Housatonic River, in the Town of
Stockbridge, Berkshire County,
Massachusetts, and has prepared an
Environmental Assessment (EA). In the
EA, Commission staff analyze the
potential environmental effects of
relicensing the project and conclude
that issuing a subsequent license for the
project, with appropriate environmental
