SUPPLEMENTARY INFORMATION: The Office
of Management and Budget (OMB)
regulations at 5 CFR Part 1320, which
implement provisions of the Paperwork
Reduction Act of 1995 (Pub. L. 104–13),
require that interested members of the
public and affected agencies have an
opportunity to comment on information
collection and recordkeeping activities
[see 5 CFR 1320.8(d)]. This notice
identifies information collection that
OSM will be submitting to OMB for
approval. This collection is contained in
30 CFR Part 733—Maintenance of State
Programs and Procedures for
Substituting Federal Enforcement of
State Programs and Withdrawing
Approval of State Programs. OSM will
request a 3-year term of approval for
each information collection activity.
Before including your address, phone
number, e-mail address, or other
personal identifying information in your
comment, you should be aware that
your entire comment, including your
personal identifying information, may
be made publicly available at any time.
While you can ask us in your comment
to withhold your personal identifying
information from public review, we
cannot guarantee that we will be able to

Comments are invited on: (1) The
need for the collection of information
for the performance of the functions of
the agency; (2) the accuracy of the
agency’s burden estimates; (3) ways to

Determination
On the basis of the record 1 developed
in the subject investigation, the United
States International Trade Commission
(Commission) determines, pursuant to
section 735(b) of the Tariff Act of 1930
(19 U.S.C. 1673d(b)) (the Act), that an
industry in the United States is
materially injured by reason of imports
from China of small diameter graphite
electrodes, provided for in subheading
8545.11.00 of the Harmonized Tariff
Schedule of the United States, that have
been found by the Department of
Commerce (Commerce) to be sold in the
United States at less than fair value
(LTFV).2
Background
The Commission instituted this
investigation effective January 17, 2008,
following receipt of a petition filed with
the Commission and Commerce by SGL
Carbon LLC, Charlotte, NC, and
Superior Graphite Co., Chicago, IL. The
final phase of the investigation was
scheduled by the Commission following
notification of a preliminary
