We will place a copy of the plat we described in the open files. It will be available to the public as a matter of information. If BLM receives a protest against this survey, as shown on the plat, prior to the date of the official filing, we will stay the filing pending our consideration of the protest. We will not officially file the plat until the day after we have accepted or dismissed all protests and they have become final, including decisions on appeals. Background: As requested by the USTR, under the authority delegated by the President, pursuant to section 332(g) of the Tariff Act of 1930, and in accordance with sections 503(d)(1)(A) of the Trade Act of 1974 (1974 Act) (19 U.S.C. 2463(d)(1)(A)), the Commission will provide advice on whether any industry in the United States is likely to be adversely affected by a waiver of the competitive need limits specified in section 503(c)(2)(A) of the 1974 Act for the following countries and articles provided for in the noted subheadings of the Harmonized Tariff System (HTS): Argentina for HTS subheading 4107.91.80 and 7202.99.20; Brazil for HTS subheading 2922.41.00; India for HTS subheading 7202.41.00; Indonesia for HTS subheading 3907.60.00; and Turkey for HTS subheading 7413.00.10. As requested, the Commission will also provide advice in accordance with section 503(c)(2)(E) of the 1974 Act with respect to whether like or directly competitive products were being produced in the United States on January 1, 1995. In addition, as requested, the Commission will provide advice as to the probable economic effect on total U.S. imports, and on consumers, of the petitioned waivers. As requested by the USTR, the Commission will use the dollar value limit of $135,000,000 for purposes of section 503(c)(2)(A)(i)(I) of the 1974 Act. As requested by the USTR, the Commission will provide its advice by April 13, 2009. The USTR indicated that those sections of the Commission’s report and related working papers that contain the Commission’s advice will be classified as ‘‘confidential.’’ Public Hearing: A public hearing in connection with this investigation will be held at the U.S. International Trade Commission Building, 500 E Street, SW., Washington, DC, beginning at 9:30 a.m. on February 27, 2009.
