Notice of Lodging of Consent Decree
Under the Comprehensive
Environmental Response,
Compensation and Liability Act
Notice is hereby given that on
December 29, 2008, a proposed Consent
Decree in United States v. Amana Co.
L.P., et al., Civil Action No. 08-cv-6000
was lodged with the United States
District Court for the Eastern District of
Pennsylvania.
In this action the United States sought
reimbursement of response costs
incurred in connection with property
known as the Novak Sanitary Landfill
Superfund Site (the ‘‘Site’’), located in
South Whitehall Township, Lehigh
County, Pennsylvania. The Consent
Decree obligates the Settling Defendants
to reimburse $862,050 of the United
States’ past response costs paid in
connection with the Site from January
10, 1998 through September 30, 2006,
and all response costs paid or to be paid
after that date.
The Department of Justice will receive
for a period of thirty (30) days from the
