For the 12-month period ending
September 30, 2008, the Commission
has determined the level of U.S.
consumption of fuel ethyl alcohol to be
8.88 billion gallons; 7 percent of this
amount is 621.5 million gallons (these
figures have been rounded). Therefore,
the base quantity for 2009 should be
621.5 million gallons.

Background: Section 423(c) of the Tax
Reform Act of 1986, as amended, which
concerns local feedstock requirements
for fuel ethyl alcohol imported by the
United States from U.S. insular
possessions or CBERA-beneficiary
countries, requires that the Commission
determine annually the amount that is
equal to 7 percent of the U.S. domestic
market for fuel ethyl alcohol. The
Commission published its notice
instituting this investigation in the
Federal Register of March 21, 1990 (55
FR 10512), and published its most
recent previous determination for the

2008 amount in the Federal Register of
December 28, 2007 (72 FR 73883). The
Commission uses official statistics of the
U.S. Department of Energy to make
these determinations, as well as the
PIERS database of the Journal of
Commerce, which is based on U.S.
export declarations.

Cooperative Research and Production
Act of 1993—Interchangeable Virtual
Instruments Foundation, Inc.
Notice is hereby given that, on
November 3, 2008, pursuant to Section
6(a) of the National Cooperative
Research and Production Act of 1993,
15 U.S.C. 4301 et seq. (‘‘the Act’’),
Interchangeable Virtual Instruments
Foundation, Inc. has filed written
notifications simultaneously with the
Attorney General and the Federal Trade
Commission disclosing changes in its
membership. The notifications were
filed for the purpose of extending the
Act’s provisions limiting the recovery of
antitrust plaintiffs to actual damages
under specified circumstances.
Specifically, Honeywell Technology
Solutions, Bangalore, INDIA; Easbeacon
Test Systems Ltd., Beijing, PEOPLE’S
REPUBLIC OF CHINA; The Boeing
Company, St. Louis, St. Louis, MO; and
Raytheon Missile Systems, Tucson, AZ
have withdrawn as parties to this
venture. In addition, Xantrex
Technology, Inc. has changed its name
to Ametek Programmable Power, San
Diego, CA.
No other changes have been made in
either the membership or planned
activity of the group research project.
Membership in this group research
project remains open, and
Interchangeable Virtual Instruments
Foundation, Inc. intends to file
additional written notifications
disclosing all changes in membership.
On May 29, 2001, Interchangeable
Virtual Instruments Foundation, Inc.
filed its original notification pursuant to
Section 6(a) of the Act. The Department
of Justice published a notice in the
Federal Register pursuant to Section
6(b) of the Act on July 30, 2001 (66 FR
39336).
