I. Introduction

The U.S. Nuclear Regulatory Commission (NRC) is issuing for public
comment a draft regulatory guide in the agency's ``Regulatory Guide''
series. This series was developed to describe and make available to the
public such information as methods that are acceptable to the NRC staff
for implementing specific parts of the NRC's regulations, techniques
that the staff uses in evaluating specific problems or postulated
accidents, and data that the staff needs in its review of applications

the NRC considers acceptable for use in complying with Title 10,
Section 70.23(a)(3) and (a)(4), of the Code of Federal Regulations (10
CFR 70.23(a)(3) and (a)(4)) with respect to fire protection, and with
10 CFR 70.61, ``Performance Requirements,'' with respect to potential
radiological consequences from fires, for a mixed oxide (MOX) facility.
The NRC regulations in 10 CFR Part 70, ``Domestic Licensing of
Special Nuclear Material,'' establish procedures and criteria for the
licensing of special nuclear material (SNM). In 10 CFR Part 70, Subpart
D, ``License Applications,'' the regulations specify the contents of
license applications and the requirements for approving applications.
As stipulated in 10 CFR 70.23(a) and (b), the requirements for approval
include that the applicant's proposed equipment, facilities, and
procedures be adequate to protect health and minimize danger to life or
property.
