described Puget’s request to amend the

2007. On June 2, 2008 and August 22,
2008, Puget filed additional information
that included a proposal for the
remediation of contaminated soils at the
project. The remediation work would
occur in conjunction with other project
modifications proposed in the December
6, 2007 application for amendment of
the project license.

license is currently before the U.S. Court
of Appeals for the Ninth Circuit. Any
final Commission action would have to
be by leave of the court.
