SUPPLEMENTARY INFORMATION: I. Background Section 4144 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU, Pub. L. 109–59) required the Secretary of the U.S. Department of Transportation to establish in FMCSA, a Motor Carrier Safety Advisory Committee. The advisory committee operates in accordance with the Federal Advisory Committee Act (5 U.S.C. App 2). Harsco Track Technologies (Waiver Petition Docket Number FRA–2008– 0070) Harsco Track Technologies (HTT) is seeking a waiver of compliance from 49 CFR Part § 214.505(a), pertaining to enclosed cabs on on-track roadway maintenance machines (RMM). Specifically, HTT would like relief from the requirement of an enclosed cab, operable heating and air conditioning system, and positive pressurized ventilation system on a remotely controlled RMM.
