and intermittently operated at remote
oil and gas exploration sites on the
North Slope of Alaska is subject to
NSPS subpart CCCC. EPA considers this
incinerator to be located at an industrial
facility, and regardless of the fact that
the incinerator may be moved from one
location to the next, it will be a distinct
operating unit of an industrial facility.
Q2: Is 40 CFR part 61, subpart E,
applicable to an incineration unit that
incinerates untreated sanitary waste
(solids) collected from Pacto toilets?
A2: No. EPA considers the Mercury
NESHAP to apply to ‘‘those stationary
sources which * * * incinerate or dry
wastewater treatment plant sludge.’’
Under 40 CFR 61.51, sludge is defined
as ‘‘sludge produced by a treatment
plant that processes municipal or
industrial waste waters.’’ The practice of
incinerating sanitary waste composed of
untreated solids from Pacto toilets does
not meet the description of incinerating
sludge under the Mercury NESHAP.
Thus, the Mercury NESHAP would not
apply.
