other rules subject to the imposition of
fines under the MRVP. The Commission
believes that the violation of any selfregulatory organization rules, as well as
Commission rules, is a serious matter.
However, the MRVP provides a
reasonable means of addressing rule
violations that do not rise to the level of
requiring formal disciplinary
proceedings, while providing greater
flexibility in handling certain violations.
The Commission expects that FINRA
will continue to conduct surveillance
with due diligence and make a
determination based on its findings, on
a case-by-case basis, whether a fine of
more or less than the recommended
amount is appropriate for a violation
under the MRVP or whether a violation
requires formal disciplinary action.
FINRA has requested that the
Commission find good cause for
approving the proposed rule change
prior to the thirtieth day after
publication of the notice thereof in the
Federal Register. The Commission
hereby grants that request. FINRA’s
proposal is substantially similar to those
of other options exchanges, which
previously have been approved by the
Commission.12 The Commission does
not believe that FINRA’s proposal raises
any novel regulatory issues, and no
comments were received on any of these
earlier proposals. Accordingly, the
Commission finds good cause, pursuant
to Section 19(b)(2) of the Act,13 for
approving the proposed rule change
prior to the thirtieth day after
publication of the notice thereof in the
Federal Register.
V. Conclusion
It is therefore ordered, pursuant to
Section 19(b)(2) of the Act 14 and Rule
19d–1(c)(2) under the Act,15 that the
proposed rule change (SR–FINRA–
2008–023), be, and hereby is, approved
and declared effective on an accelerated
basis.

Acting under the authority of section
1(b) of Executive Order 13224 of
September 23, 2001, as amended by
Executive Order 13286 of July 2, 2002,

23, 2003, and in consultation with the
Secretary of the Treasury, the Attorney

Security, I hereby determine that the
organization known as the Rajah
Solaiman Movement (RSM) and aliases
and transliterations listed above has
committed, or poses a significant risk of
committing, acts of terrorism that
threaten the security of U.S. nationals or
the national security, foreign policy, or
economy of the United States. In
addition, I find that RSM leader Ahmed
Santos and aliases has committed or
poses a significant risk of committing
acts of terrorism that threaten the
security of U.S. nationals or the national
security, foreign policy, or economy of
the United States.
Consistent with the determination in
section 10 of Executive Order 13224 that
‘‘prior notice to persons determined to
be subject to the Order who might have
a constitutional presence in the United
States would render ineffectual the
blocking and other measures authorized
in the Order because of the ability to
transfer funds instantaneously,’’ I
determine that no prior notice need be
provided to any person subject to this
determination who might have a
constitutional presence in the United
States, because to do so would render
ineffectual the measures authorized in
the Order.
This notice shall be published in the
Federal Register.
