SUPPLEMENTARY INFORMATION: The
Commission instituted Inv. No. 337–

Samsung Electronics Co., Ltd. of Seoul,
Korea (‘‘Samsung’’) on May 7, 2007. 72
FR 32863 (June 14, 2007). The
complaint, as amended, alleged
violations of section 337 of the Tariff
Act of 1930 (19 U.S.C. 1337) in the
importation into the United States, the
sale for importation, and the sale within
the United States after importation of
certain semiconductor devices, DMA
systems, and products containing same
by reason of infringement of certain
claims of U.S. Patent No. 5,613,162 and
U.S. Patent No. 7,064,026. The notice of
investigation named Renesas
Technology Corp. of Tokyo, Japan and
Renesas Technology America, Inc. of

complaint, as amended, further alleged
that an industry in the United States
exists as required by subsection

On April 25, 2008, Samsung and
Renesas jointly moved to terminate the
investigation based on a settlement
agreement. On April 29, 2008, the
Commission investigative attorney filed
a response supporting the motion.
On May 19, 2008, the ALJ issued the
subject ID (Order No. 73) granting the

investigation based on a settlement
agreement. The ALJ found that the joint
motion complied with the requirements
of Commission Rule 210.21(b) (19 CFR
210.21(b)). In addition, the ALJ
concluded, pursuant to Commission
Rule 210.50(b)(2) (19 CFR 210.50(b)(2)),
that there is no evidence that
termination of this investigation will
prejudice the public interest. No
petitions for review of this ID were filed.
The Commission has determined not
to review the ID.
The authority for the Commission’s
determination is contained in section
337 of the Tariff Act of 1930, as
amended (19 U.S.C. 1337), and in
section 210.42 of the Commission’s
Rules of Practice and Procedure (19 CFR
210.42).
