AGENCY: EPA is granting a registrant’s voluntary request for cancellation, pursuant to section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA),of the pesticide product Tree Guard, EPA Reg. The comments stated that there is a great need for deer repellent and the annual 300 lb distribution and sales limit is arbitrary and unwarranted. The Agency appreciates the submitted comments, however the distribution and sales limit is a condition of the voluntary cancellation. For this reason, the Agency does not believe that the comments submitted during the comment period merit further review or a denial of the requests for voluntary cancellation. IV. Cancellation Order Pursuant to FIFRA section 6(f), EPA hereby approves the requested cancellation of Tree Guard, EPA Reg. No. 66676-1. Accordingly, the Agency orders that the registration of Tree Guard, EPA Reg. No. 66676-1, is hereby canceled effective December 1, 2009. Section 6(f)(1) of FIFRA provides that a registrant of a pesticide product may at any time request that any of its pesticide registrations be canceled or amended to terminate one or more uses. FIFRA further provides that, before acting on the request, EPA must publish a notice of receipt of any such request in the Federal Register. Thereafter, following the public comment period, the Administrator may approve such a request. VI. Provisions for Disposition of Existing Stocks Existing stocks are those stocks of registered pesticide products which are currently in the United States and which were packaged, labeled, and released for shipment prior to the effective date of the cancellation action. The cancellation order issued in this notice includes the following existing stocks provisions. ACTION: Notice. AGENCY: SUMMARY: This notice announces the availability of EPA’s final risk mitigation decision for 10 rodenticides, an addendum to the economic impact assessment, responses to comments on the proposed risk mitigation decision, PO 00000 Frm 00060 Fmt 4703 Sfmt 4703 and other supporting documents. The 10 rodenticides covered by this risk mitigation decision are brodifacoum, bromadiolone, bromethalin, chlorophacinone, cholecalciferol, difenacoum, difethialone, diphacinone (and its sodium salt), warfarin (and its sodium salt), and zinc phosphide. EPA’s final decision on the rodenticides includes two major components. To minimize children’s exposure to rodenticide products used in homes, EPA is requiring that in the future, all rodenticide bait products available for sale to general consumers be sold only in bait stations. To reduce wildlife exposures and ecological risks, the Agency intends to prevent general consumers from purchasing bait products containing the rodenticides that pose the greatest risk to wildlife (the second generation anticoagulants – brodifacoum, bromadiolone, difethialone, and difenacoum) by requiring various measures to control sales and distribution. The Agency’s decision will reduce rodenticide exposures to children and non-target wildlife, while ensuring residential users, livestock producers, and professional applicators access to a variety of effective and affordable rodent control products.
