SUMMARY: This document contains a correction to the regulations of the Department of Veterans Affairs (VA) that governs presumptive service connection for certain diseases from exposure to ionizing radiation during military service. This correction is required in order to amend a crossreference in the regulation. No substantive change to the content of the regulations is being made by this correcting amendment. SUPPLEMENTARY INFORMATION: VA published a final rule in the Federal Register on April 27, 1993 (See 58 FR 25563), to implement Section 2 of the Veterans’ Radiation Exposure Amendments of 1992, Public Law 102– 578, which amended 38 U.S.C. 1112(c) to repeal the requirement that, to be presumed service connected, specified diseases of veterans who participated in a radiation-risk activity to become at least 10 percent disabling within 40 years after the veterans’ last exposure to radiation. Accordingly, VA removed 38 CFR 3.309(d)(3) and redesignated § 3.309(d)(4) as the new § 3.309(d)(3). However, VA neglected to amend the reference to the redesignated § 3.309(d)(3) that appears at § 3.309(d)(3)(vii)(C). This document corrects that omission by removing ‘‘(d)(4)(vi)’’ and adding, in its place, ‘‘(d)(3)(vi)’’. ACTION: Final rule. AGENCY: SUMMARY: This regulation establishes an exemption from the requirement of a tolerance for residues of 2-oxepanone, homopolymer; (CAS Reg. No. 24980– 41–4) when used as an inert ingredient in a pesticide chemical formulation. Solvay Chemicals, Inc. submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA) requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of 2oxepanone, homopolymer. DATES: This regulation is effective June 4, 2008. ACTION: Correcting amendment.
