SCCP believes that the proposed rule
change is consistent with Section 17A of
the Act,6 in general, and with Section
17A(b)(3)(A) of the Act,7 in particular,
in that it is designed to ensure that
SCCP is so organized and has the
capacity to be able to facilitate the
prompt and accurate clearance and
settlement of securities transactions.

SCCP does not believe that the
proposed rule change will impose any
burden on competition not necessary or
appropriate in furtherance of the
purposes of the Act.

III. Date of Effectiveness of the
Proposed Rule Change and Timing for

Within thirty-five days of the date of
publication of this notice in the Federal

(i) as the Commission may designate up
to ninety days of such date if it finds
such longer period to be appropriate
and publishes its reasons for so finding
or (ii) as to which the self-regulatory
organization consents, the Commission
will:
(A) By order approve such proposed
rule change or
(B) institute proceedings to determine
whether the proposed rule change
should be disapproved.

Export Control Act
Pursuant to Section 40A of the Arms Export Control Act (22 U.S.C.
2781), and Executive Order 11958, as amended, I hereby determine and
certify to the Congress that the following countries are not
cooperating fully with United States antiterrorism efforts: Cuba;
Eritrea; Iran; North Korea; Syria; Venezuela.
I hereby notify that the decision to retain the certification of
North Korea pursuant to Section 40A of the Arms Export Control Act
comes during an ongoing review of the designation of North Korea as a
state sponsor of terrorism. The outcome of this review may warrant a
re-assessment of whether North Korea should be included among the
Countries certified as not cooperating fully with United States
antiterrorism efforts.
This determination and certification shall be transmitted to the
Congress and published in the Federal Register.
