Background Section 4144 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA–LU, Pub. L. 109–59) required the Secretary of the U.S. Department of Transportation to establish in FMCSA, a Motor Carrier Safety Advisory Committee. The advisory committee provides advice and recommendations to the FMCSA Administrator on motor carrier safety programs and motor carrier safety regulations. The advisory committee operates in accordance with the Federal Advisory Committee Act (5 U.S.C. App 2). The Union Pacific Railroad Company (UP) seeks approval of the proposed discontinuance and removal of the electric locks and circuit controllers on the Conley frogs on the moveable span bridge over the White River at Milepost 298.5, on the UP Memphis Subdivision, near Augusta, Arkansas. The reason given for the proposed changes is that the Conley frogs are selfaligning and require no locking device. Any interested party desiring to protest the granting of an application shall set forth specifically the grounds upon which the protest is made, and include a concise statement of the interest of the party in the proceeding. Additionally, one copy of the protest shall be furnished to the applicant at the address listed above. FRA expects to be able to determine these matters without an oral hearing.
