Purchase Obligation. The amendment is
titled a motion for leave to file answer
and answer to Smurfit Stone Container
Corporation’s motion to intervene,
limited protest and comments. The
amendment includes the net capacity of
the potentially-affected qualifying
facilities. This information was missing
from the initial application.
Because the filing constitutes a
material amendment to the March 10,
2008, application filed by Virginia
Electric and Power Company, the 90day period within which the
Commission must act on this
application begins on the date of the
amended filing. The Commission will
act on the application on or before July
21, 2008, unless the application is again
materially amended.
Any person desiring to intervene or to
protest this filing must file in
accordance with Rules 211 and 214 of
the Commission’s Rules of Practice and
Procedure (18 CFR 385.211, 385.214).
Protests will be considered by the
Commission in determining the
appropriate action to be taken, but will
not serve to make protestants parties to
the proceeding. Any person wishing to

intervention or motion to intervene, as
appropriate. Such notices, motions, or

comment date. On or before the
comment date, it is not necessary to

Requests to Voluntarily Cancel Certain
Pesticide Registrations
Environmental Protection

ACTION: Notice.
AGENCY:
In accordance with section
6(f)(1) of the Federal Insecticide,
Fungicide, and Rodenticide Act
(FIFRA), as amended, EPA is issuing a
notice of receipt of requests by the
registrants to voluntarily cancel the
registrations for all of their products
containing 4-chloro-alpha-(1methylethyl)benzeneacetic acid,
cyano(3-phenoxyphenyl)methyl ester
(fenvalerate). The requests would
terminate the last fenvalerate products
registered for use in the United States.
EPA intends to grant these requests at
the close of the comment period for this
announcement unless the Agency
receives substantive comments within
the comment period that would merit its
further review of the requests, or unless
the registrants withdraw their requests
within this period. Upon acceptance of
these requests, any sale, distribution, or
use of products listed in this notice will
be permitted only if such sale,
distribution, or use is consistent with
the terms as described in the final order.
