SUMMARY: Comments are requested on
the proposed Base (1 percent annualchance) Flood Elevations (BFEs) and
proposed BFE modifications for the
communities listed in the table below.
The purpose of this notice is to seek
general information and comment
regarding the proposed regulatory flood
elevations for the reach described by the
downstream and upstream locations in
the table below. The BFEs and modified
BFEs are a part of the floodplain
management measures that the
community is required either to adopt
or show evidence of having in effect in

order to qualify or remain qualified for
participation in the National Flood
Insurance Program (NFIP). In addition,
these elevations, once finalized, will be
used by insurance agents, and others to
calculate appropriate flood insurance
premium rates for new buildings and
the contents in those buildings.
Comments are to be submitted
on or before July 28, 2008.

(FIRM) for the proposed BFEs for each
community are available for inspection
at the community’s map repository. The
respective addresses are listed in the
table below.

The
Federal Emergency Management Agency
(FEMA) proposes to make
determinations of BFEs and modified
BFEs for each community listed below,
in accordance with section 110 of the
SUPPLEMENTARY INFORMATION:
Flooding source(s)
CFR part 10, Environmental
Consideration. An environmental
impact assessment has not been
prepared.
Regulatory Flexibility Act. As flood
elevation determinations are not within
the scope of the Regulatory Flexibility
Act, 5 U.S.C. 601–612, a regulatory
flexibility analysis is not required.
Executive Order 12866, Regulatory
Planning and Review. This proposed
rule is not a significant regulatory action
under the criteria of section 3(f) of
Executive Order 12866, as amended.
Executive Order 13132, Federalism.
This proposed rule involves no policies
that have federalism implications under
Executive Order 13132.
Executive Order 12988, Civil Justice
Reform. This proposed rule meets the
applicable standards of Executive Order
12988.
Flood Disaster Protection Act of 1973,
42 U.S.C. 4104, and 44 CFR 67.4(a).
These proposed BFEs and modified
BFEs, together with the floodplain
management criteria required by 44 CFR
60.3, are the minimum that are required.
They should not be construed to mean
that the community must change any
existing ordinances that are more
stringent in their floodplain
management requirements. The
community may at any time enact
stricter requirements of its own, or
pursuant to policies established by other
Federal, State, or regional entities.
These proposed elevations are used to
meet the floodplain management
requirements of the NFIP and are also
used to calculate the appropriate flood
insurance premium rates for new
buildings built after these elevations are
made final, and for the contents in these
buildings.
Comments on any aspect of the Flood
Insurance Study and FIRM, other than
the proposed BFEs, will be considered.
A letter acknowledging receipt of any
comments will not be sent.
Administrative Procedure Act
Statement. This matter is not a
rulemaking governed by the
Administrative Procedure Act (APA), 5
U.S.C. 553. FEMA publishes flood
elevation determinations for notice and
comment; however, they are governed
by the Flood Disaster Protection Act of
1973, 42 U.S.C. 4105, and the National
Flood Insurance Act of 1968, 42 U.S.C.
4001 et seq., and do not fall under the
APA.
National Environmental Policy Act.
This proposed rule is categorically
excluded from the requirements of 44
List of Subjects in 44 CFR Part 67
Administrative practice and
procedure, Flood insurance, Reporting
and recordkeeping requirements.
Accordingly, 44 CFR part 67 is
proposed to be amended as follows:

SUMMARY: We, the U.S. Fish and
Wildlife Service (Service), announce a
90-day finding on a petition to list the
western sage-grouse (Centrocercus
urophasianus phaios) as threatened or
endangered under the Endangered
Species Act of 1973, as amended (Act).
We find that the petition presents
substantial scientific or commercial
information indicating that listing the
western sage-grouse may be warranted.
Therefore, with the publication of this
notice, we are initiating a status review
to determine if listing the species is
warranted. To ensure that the status
review is comprehensive, we are
soliciting scientific and commercial
information regarding this species. We
will initiate a determination on critical
habitat for this species if and when we
initiate a listing action.

Information Solicited
When we make a finding that a
petition presents substantial
information indicating that listing a
species may be warranted, we are
required to promptly commence a
review of the status of the species. To
ensure that the status review is
complete and based on the best
available scientific and commercial
information, we are soliciting
information on the western sage-grouse.
We request any additional information
from the public, other concerned
governmental agencies, Native
American Tribes, the scientific
community, industry, or any other
interested parties on the status of the
western sage-grouse, including:
(1) Information regarding the
taxonomic validity of western sagegrouse as a subspecies of the greater
sage-grouse (e.g., based on
morphological, behavioral, geographic,
genetic, or other diagnostic factors),
either as petitioned or along another
geographic boundary;
(2) Information regarding the
significance, if any, of recent genetic
studies on the taxonomic classification
of the western sage-grouse, such as the
conclusion of Benedict et al. (2003, p.
309) that studies of mitochondrial DNA
do not support the subspecies
delineation, or the potential
significance, if any, of the distribution
of the unique haplotypes or populations
clusters identified by Oyler-McCance et
al., 2005;
(3) Information as to the identity and
text of the document that the petitioner
references in support of behavioral
differences in sage-grouse and cites on
page 7 of the petition as ‘‘US Fish and
Wildlife Service 1998, p. 1 of
attachment entitled ‘‘Sage Grouse’’—
(Candidate Conservation?).’’ We have
been unable to determine what
document the petitioner is referring to,
and the petitioner has not responded to
our requests to clarify the reference;

historical and current population status,
distribution, and trends of western sagegrouse; its biology and ecology; and
habitat selection;
(5) Information on the effects of
potential threat factors relevant to
western sage-grouse that are the basis
for a listing determination under
Section 4(a) of the Act, which are: (a)
The present or threatened destruction,
modification, or curtailment of its
habitat or range; (b) overutilization for
commercial, recreational, scientific, or
educational purposes; (c) disease or
predation; (d) the inadequacy of existing
regulatory mechanisms; and (e) other
natural or manmade factors affecting its
continued existence; and
(6) Information on management
programs for the conservation of the
western sage-grouse.
Please note that submissions merely
stating support for or opposition to the
action under consideration without
providing supporting information,
although noted, will not be considered
in making a determination, as section
4(b)(1)(A) of the Act directs that
determinations as to whether any
species is a threatened or endangered
species shall be made ‘‘solely on the
basis of the best scientific and
commercial data available.’’ Based on
the status review, we will issue the 12month finding on the petition, as
provided in section 4(b)(3)(B) of the Act.

SUMMARY: Comments are requested on the proposed Base (1 percent annual-
chance) Flood Elevations (BFEs) and proposed BFE modifications for the
communities listed in the table below. The purpose of this notice is to
seek general information and comment regarding the proposed regulatory
flood elevations for the reach described by the downstream and upstream
locations in the table below. The BFEs and modified BFEs are a part of
the floodplain management measures that the community is required
either to adopt or show evidence of having in effect in

order to qualify or remain qualified for participation in the National
Flood Insurance Program (NFIP). In addition, these elevations, once
finalized, will be used by insurance agents, and others to calculate
appropriate flood insurance premium rates for new buildings and the
contents in those buildings.

SUPPLEMENTARY INFORMATION: The Federal Emergency Management Agency
(FEMA) proposes to make determinations of BFEs and modified BFEs for
each community listed below, in accordance with section 110 of the
Flood Disaster Protection Act of 1973, 42 U.S.C. 4104, and 44 CFR
67.4(a).
These proposed BFEs and modified BFEs, together with the floodplain
management criteria required by 44 CFR 60.3, are the minimum that are
required. They should not be construed to mean that the community must
change any existing ordinances that are more stringent in their
floodplain management requirements. The community may at any time enact
stricter requirements of its own, or pursuant to policies established
by other Federal, State, or regional entities. These proposed
elevations are used to meet the floodplain management requirements of
the NFIP and are also used to calculate the appropriate flood insurance
premium rates for new buildings built after these elevations are made
final, and for the contents in these buildings.
Comments on any aspect of the Flood Insurance Study and FIRM, other
than the proposed BFEs, will be considered. A letter acknowledging
receipt of any comments will not be sent.
Administrative Procedure Act Statement. This matter is not a
rulemaking governed by the Administrative Procedure Act (APA), 5 U.S.C.
553. FEMA publishes flood elevation determinations for notice and
comment; however, they are governed by the Flood Disaster Protection
Act of 1973, 42 U.S.C. 4105, and the National Flood Insurance Act of
1968, 42 U.S.C. 4001 et seq., and do not fall under the APA.
National Environmental Policy Act. This proposed rule is
categorically excluded from the requirements of 44 CFR part 10,
Environmental Consideration. An environmental impact assessment has not
been prepared.
Regulatory Flexibility Act. As flood elevation determinations are
not within the scope of the Regulatory Flexibility Act, 5 U.S.C. 601-
612, a regulatory flexibility analysis is not required.
Executive Order 12866, Regulatory Planning and Review. This
proposed rule is not a significant regulatory action under the criteria
of section 3(f) of Executive Order 12866, as amended.
Executive Order 13132, Federalism. This proposed rule involves no
policies that have federalism implications under Executive Order 13132.
Executive Order 12988, Civil Justice Reform. This proposed rule
meets the applicable standards of Executive Order 12988.
