SUMMARY: This notice provides a revised statement of policy concerning 
the FHWA's process for reviewing Buy America Waiver requests on 
Federal-aid highway construction projects. The FHWA has established a 
Web page to provide the public with an informal notice and comment 
opportunity for all Buy America waiver requests.

DATES: The policy became effective on December 26, 2007, when the 
President signed Public Law 110-161, the ``Consolidated Appropriations 
Act, 2008'' into law.

Background

    The FHWA's Buy America policy in 23 CFR 635.410 requires a domestic 
manufacturing process for any steel or iron products (including 
protective coatings) that are permanently incorporated in a Federal-aid 
construction project. The regulation also provides for a waiver of the 
Buy America requirements when the application would be inconsistent 
with the public interest or when satisfactory quality domestic steel 
and iron products are not sufficiently available.
    This notice provides information regarding the FHWA's 
implementation of an informal Buy America waiver notification and 
comment process as required by Public Law 110-161, the ``Consolidated 
Appropriations Act, 2008.'' Division K, Section 130 of this law states:
