Agreement addresses the Barker
Hughesville (Block P) Site in Cascade
and Judith Basin Counties, Montana.
Under the proposed settlement, the
United States will have an allowed
general unsecured claim of $1 million
and the State of Montana will have an
allowed general unsecured claim of $7.1
million.
For thirty (30) days after the date of

United States v. Cookson Group PLC,
et. al.; Proposed Final Judgment and
Competitive Impact Statement
Notice is hereby given pursuant to the
Antitrust Procedures and Penalties Act,
15 U.S.C. 16(b)–(h), that a proposed
Final Judgment and Competitive Impact
Statement have been filed with the
United States District Court for the
District of Columbia in United States v.
Cookson Group plc, et. al., Civil Action
No. 1:08–cv–00389. On March 4, 2008,
the United States filed a Complaint to
obtain equitable and other relief against
defendants Cookson Group plc and
Cookson America Inc. (‘‘Cookson’’), and
Foseco plc and Foseco Metallurgical
Inc. (‘‘Foseco’’) to prevent Cookson’s
proposed acquisition of Foseco. The
Complaint alleges that Cookson’s
acquisition of Foseco’s United States
carbon-bonded ceramic refractory
(‘‘CBC’’) business would substantially
lessen competition in the United States
in the development, manufacture, and
sale of certain CBCs, in violation of
section 7 of the Clayton Act, as
amended, 15 U.S.C. 18. The proposed
Final Judgment, filed on March 4, 2008,
requires defendants to divest Foseco’s
entire United States CBC business,
including its plant in Saybrook, Ohio
and related assets.
