B. What is the Agency’s Authority for
Taking this Action?
Section 4(g)(2) of FIFRA, as amended,
directs that, after submission of all data
concerning a pesticide active ingredient,
‘‘the Administrator shall determine
whether pesticides containing such
active ingredient are eligible for
reregistration,’’ before calling in
product-specific data on individual enduse products and either reregistering
products or taking other ‘‘appropriate
regulatory action.’’

ACTION:
SUMMARY: California has scheduled a
special general election on April 8,
2008, to fill the U.S. House of
Representatives seat in the Twelfth
Congressional District held by the late
Representative Tom Lantos. Under
California law, a majority winner in a
special election is declared elected.
Should no candidate achieve a majority
vote, a special runoff election will be
held on June 3, 2008, among the top
vote-getters of each qualified political
party, including qualified independent
candidates.
Committees participating in the
California special elections are required
to file pre- and post-election reports.
Filing dates for these reports are affected
by whether one or two elections are
held.
