Agency to terminate the use of
chloroneb on residential lawns and turf,
as well as on lawns and turf of parks
and schools. The action on the
registrants’ requests will not terminate
the last chloroneb products registered in
the United States.
III. What Action is the Agency Taking?
This notice announces receipt by EPA
of requests from registrants to terminate
certain uses of chloroneb product
registrations. The affected products and
the registrants making the requests are
identified in Tables 1 and 2 of this unit.
Under section 6(f)(1)(A) of FIFRA,
registrants may request, at any time, that
their pesticide registrations be canceled
or amended to terminate one or more
pesticide uses. Section 6(f)(1)(B) of
FIFRA requires that before acting on a
request for voluntary cancellation, EPA
must provide a 30–day public comment
period on the request for voluntary
cancellation or use termination. In
addition, section 6(f)(1)(C) of FIFRA
requires that EPA provide a 180–day
comment period on a request for
voluntary cancellation or termination of
any minor agricultural use before
granting the request, unless:
1. The registrants request a waiver of
the comment period, or
2. The Administrator determines that
continued use of the pesticide would
pose an unreasonable adverse effect on
the environment.
The chloroneb registrants have
requested that EPA waive the 180–day
comment period. EPA will provide a
30–day comment period on the
proposed requests.
Unless a request is withdrawn by the
registrant within 30 days of publication
of this notice, or if the Agency
determines that there are substantive
comments that warrant further review of
this request, an order will be issued
terminating the affected registrations.

Users of these products who desire continued use on crops or sites
being deleted should contact the applicable registrant before June 25,
2008 or January 28, 2008 for registrations for which the registrant
requested a waiver of the 180-day comment period to discuss withdrawal
of the application for amendment. This time period will also permit
interested members of the public to intercede with registrants prior to
the Agency's approval of the deletion. A request to waive the 180-day
comment period has been received for the following registrations: 829-
286; 19713-497; 43410-33; 70506-1; 70506-2,
Table 2 of this unit includes the names and addresses of record for
all registrants of the products listed in Table 1 of this unit, in
sequence by EPA company number.

III. What is the Agency's Authority for Taking this Action?
Section 6(f)(1) of FIFRA provides that a registrant of a pesticide
product may at any time request that any of its pesticide registrations
be amended to delete one or more uses. The Act further provides that,
before acting on the request, EPA must publish a notice of receipt of
any such request in the Federal Register. Thereafter, the Administrator
may approve such a request.
IV. Procedures for Withdrawal of Request
Registrants who choose to withdraw a request for use deletion must
submit the withdrawal in writing to John Jamula at the address listed
under FOR FURTHER INFORMATION CONTACT. The Agency will consider written
withdrawal requests postmarked no later than June 25, 2008.
V. Provisions for Disposition of Existing Stocks
The Agency has authorized the registrants to sell or distribute
product under the previously approved labeling for a period of 18
months after approval of the revision, unless other restrictions have
been imposed, as in special review actions.
