III. Date of Effectiveness of the
Proposed Rule Change and Timing for
Commission Action
The foregoing rule change has become
effective pursuant to Section
19(b)(3)(A)(iii) of the Act 6 and Rule
19b–4(f)(4) 7 promulgated thereunder
because the proposal effects a change in
an existing service of OCC that (A) does
not adversely affect the safeguarding of
securities or funds in the custody or
control of OCC or for which it is
responsible and (B) does not
significantly affect the respective rights
or obligations of OCC or persons using
the service. At any time within sixty
days of the filing of the proposed rule
change, the Commission could have
summarily abrogated such rule change if
it appeared to the Commission that such
action was necessary or appropriate in
the public interest, for the protection of
investors, or otherwise in furtherance of
the purposes of the Act.

Interested persons are invited to
submit written data, views, and
arguments concerning the foregoing,
including whether the proposed rule
change is consistent with the Act.

AGENCY:
SUMMARY: The FAA has determined that
the minimum random drug and alcohol
testing percentage rates for the period
January 1, 2008 through December 31,
2008 will remain at 25 percent of safetysensitive employees for random drug
testing and 10 percent of safety-sensitive
employees for random alcohol testing.

Discussion: Pursuant to 14 CFR part
121, appendix I, section V.C, the FAA
Administrator’s decision on whether to
change the minimum annual random
drug testing rate is based on the
reported random drug test positive rate
for the entire aviation industry. If the
reported random drug test positive rate
is less than 1.00%, the Administrator
may continue the minimum random
drug testing rate at 25%. In 2006, the
random drug test positive rate was
0.55%. Therefore, the minimum random
drug testing rate will remain at 25% for
calendar year 2008.
Similarly, 14 CFR part 121, appendix
J, section III.C, requires the decision on
