this rule should be categorically

‘‘Environmental Analysis Check List’’ or
‘‘Categorical Exclusion Determination’’
is not required for this rule. Comments
on this section will be considered before
we make the final decision on whether
to categorically exclude this rule from

various definitions of terms used by the
ICAPCD and MBUAPCD. We are
proposing to approve these local rules
under the Clean Air Act as amended in

these local rules in a direct final action
without prior proposal because we
believe these SIP revisions are not
controversial. If we receive adverse
comments, however, we will publish a
timely withdrawal of the direct final
rule and address the comments in
subsequent action based on this
proposed rule. Please note that if we
receive adverse comment on an
amendment, paragraph, or section of
this rule and if that provision may be
severed from the remainder of the rule,
we may adopt as final those provisions
of the rule that are not the subject of an
adverse comment.
We do not plan to open a second

AGENCY:
SUMMARY: In the Notice of Proposed
Rulemaking (NPRM), the Federal
Communications Commission
(Commission) initiates a proceeding to
examine whether its existing rules
governing the setting of tariffed rates by
local exchange carriers (LECs) provide
incentives and opportunities for carriers
to increase access demand
endogenously with the result that the
tariff rates are no longer just and
reasonable. The Commission tentatively
concludes that it must revise its tariff
rules so that it can be confident that
tariffed rates remain just and reasonable
even if a carrier experiences or induces
significant increases in access demand.
The Commission seeks comment on the
types of activities that are causing the
