After consideration of the relevant
matter presented, the Committee has
determined that the products listed

procurement by the Federal Government
under 41 U.S.C. 46–48c and 41 CFR 51–
2.4.

On September 27, 2007, the ITC
determined pursuant to section 751(c) of
the Act, that revocation of the AD and
CVD orders on pasta from Italy and
Turkey would likely lead to
continuation or recurrence of material
injury to an industry in the United
States within a reasonably foreseeable
time. See Certain Pasta from Italy and
Turkey, Investigations Nos. 701–TA–
365–366 and 731–TA–734–735 (Second
Review), 72 FR 56382 (October 3, 2007).
Scope of the Orders
Imports covered by the orders are
shipments of certain non–egg dry pasta
in packages of five pounds four ounces
or less, whether or not enriched or
fortified or containing milk or other
optional ingredients such as chopped
vegetables, vegetable purees, milk,
gluten, diastasis, vitamins, coloring and
flavorings, and up to two percent egg
white. The pasta covered by this scope
is typically sold in the retail market, in
fiberboard or cardboard cartons, or
polyethylene or polypropylene bags of
varying dimensions.
Excluded from the scope of the orders
are refrigerated, frozen, or canned
pastas, as well as all forms of egg pasta,
with the exception of non–egg dry pasta
containing up to two percent egg white.
Also excluded are imports of organic
pasta from Italy that are accompanied by
the appropriate certificate.
The merchandise subject to review is
currently classifiable under item
1902.19.20 and 1901.90.9095 of the
Harmonized Tariff Schedule of the
United States (‘‘HTSUS’’). Although the
HTSUS subheadings are provided for
convenience and customs purposes, the
written description of the merchandise
subject to the order is dispositive.
Determination
As a result of the determinations by
the Department and the ITC that
revocation of these AD and CVD orders
would likely lead to continuation or
recurrence of dumping and
countervailable subsidies, and material
injury to an industry in the United
States, pursuant to section 751(d)(2) of
the Act, the Department hereby orders
