SUPPLEMENTARY INFORMATION:
I. Background
A. Statutory Framework
Section 1221(a) of the Energy Policy
Act of 2005 (Pub. L. 109–58) (EPAct)
added a new section 216 to the Federal
Power Act (16 U.S.C. 824p) (FPA). New
FPA section 216(a) requires the
Secretary of Energy (Secretary) 1 to
conduct a nationwide study of electric
transmission congestion 2 within one
year from the date of enactment of
EPAct and every three years thereafter.
FPA section 216(a)(2) provides
‘‘interested parties’’ with an opportunity
to offer ‘‘alternatives and
recommendations.’’ 16 U.S.C.
824p(a)(2). Following consideration of
such alternatives and recommendations,
the Secretary is required to issue a
report on the study ‘‘which may
designate any geographic area
experiencing electric energy
transmission capacity constraints or
congestion that adversely affects
consumers as a national interest electric
transmission corridor.’’ FPA section
216(a)(2), 16 U.S.C. 824p(a)(2). FPA
section 216(a)(4) states that in
determining whether to designate a
national interest electric transmission
corridor (National Corridor), the
Secretary may consider whether:
(A) the economic vitality and development
of the corridor, or the end markets served by
the corridor, may be constrained by lack of
adequate or reasonably priced electricity;
1 This report uses the terms ‘‘Secretary,’’
‘‘Department,’’ and ‘‘DOE’’ interchangeably.
2 Electric transmission congestion (congestion) is
the condition that occurs when transmission
capacity is not sufficient to enable safe delivery of
all scheduled or desired wholesale electricity
transfers simultaneously. Congestion results from a
transmission capacity constraint (constraint).
