realize additional savings through the
use of weekly entry procedures. The

The application to reorganize FTZ 181
- Site 2 is approved, subject to the Act
and the Board’s regulations, including
Section 400.28, and further subject to
the Board’s standard 2,000-acre
activation limit for the overall general–
purpose zone project, and a sunset
provision that would terminate
authority on December 31, 2012 for any
of the additional parcels at Site 2, where
no activity has occurred under FTZ
procedures before that date.

Authority
The Endangered Species Act of 1973
(ESA) requires that permits and
modifications be issued based on
findings that such actions: (1) Are
applied for in good faith; (2) would not
operate to the disadvantage of the listed
species that are the subject of the
actions; and (3) are consistent with the
purposes and policies set forth in
section 2 of the ESA. Authority to take
listed species is subject to conditions set
forth in the permits. Permits and
modifications are issued in accordance
with, and are subject to, the ESA and
NMFS’ regulations governing listed fish
