32008
Federal Register / Vol. 72, No. 111 / Monday, June 11, 2007 / Rules and Regulations
and Department of Homeland Security
Management Directive 5100.1, which
guide the Coast Guard in complying
with the National Environmental Policy
Act of 1969 (NEPA) (42 U.S.C. 4321–
4370f), and have concluded that there
are no factors in this case that would
limit the use of a categorical exclusion
under 2.B.2 of the Instruction.
Therefore, this rule is categorically
excluded, under figure 2–1, paragraph
(34)(g) of the Instruction, from further
environmental documentation. This rule
fits the category selected from paragraph
(34)(g), as it would establish a safety
zone to deal with an emergency
situation and that safety zone would be
in effect for only three hours.
A final ‘‘Environmental Analysis
Check List’’ and a final ‘‘Categorical
Exclusion Determination’’ will be
available in the docket where indicated
under ADDRESSES.
List of Subjects in 33 CFR Part 165
Harbors, Marine safety, Navigation
(water), Reporting and recordkeeping
requirements, Security measures,
Waterways.
■ For the reasons discussed in the
preamble, the Coast Guard amends 33
CFR part 165 as follows:
this part, entry into or movement within
this zone by any person or vessel is
prohibited unless authorized by the
Captain of the Port (COTP), Boston or
the COTP’s designated representative.
(2) The safety zone is closed to all
vessel traffic, except as may be
permitted by the COTP or the COTP’s
designated representative.
(3) Vessel operators desiring to enter
or operate within the safety zone must
contact the COTP or the COTP’s
designated representative on VHF
Channel 16 (156.8 MHz) to seek
permission to do so. If permission is
granted, vessel operators must comply
with all directions given to them by the
COTP or the COTP’s designated
representative.
Dated: May 31, 2007.

Captain, U.S. Coast Guard, Captain of the
Port, Boston, Massachusetts.
