by the Commission.39 The Commission
does not believe that NYSE Arca’s
proposal raises any novel regulatory
issues and, therefore, believes that good
cause exists for approving the filing
before the conclusion of a notice-andcomment period. Accelerated approval
of the proposal will expedite the listing
and trading of additional ETFs by the
Exchange, subject to consistent and
reasonable standards. Therefore, the
Commission finds good cause,
consistent with Section 19(b)(2) of the
Exchange Act,40 to approve the
proposed rule change, as amended, on
an accelerated basis.
Notice is
hereby given that as a result of the
President’s major disaster declaration on
5/11/2007, Private Non-Profit
organizations that provide essential
services of a governmental nature may
file disaster loan applications at the
address listed above or other locally
announced locations.
