Red Shield Environmental, LLC (Red Shield) filed an application for marketbased rate authority, with an accompanying rate schedule. The proposed market-based rate schedule provides for the sale of energy and capacity at market-based rates. Red Shield also requested waivers of various Commission regulations. In particular, Red Shield requested that the Commission grant blanket approval under 18 CFR Part 34 of all future issuances of securities and assumptions of liability by Red Shield. On March 20, 2007, pursuant to delegated authority, the Director, Division of Tariffs and Rates—West, granted the requests for blanket approval under Part 34. The Director’s order also stated that the Commission would publish a separate notice in the Federal Register establishing a period of time for the filing of protests. CARE further alleges SCE and Blythe failed to file their rates and the rates approved by the California Public Utilities Commission do not serve the ‘‘public interest’’ under the FPA and are in fact unduly preferential and discriminatory against their party customers, and impose an excessive burden on these customers.
