The
Federal Emergency Management Agency
(FEMA) proposes to make
determinations of BFEs and modified
BFEs for each community listed below,
in accordance with section 110 of the
Flood Disaster Protection Act of 1973,
42 U.S.C. 4104, and 44 CFR 67.4(a).
These proposed BFEs and modified
BFEs, together with the floodplain
management criteria required by 44 CFR
60.3, are the minimum that are required.
They should not be construed to mean
that the community must change any
existing ordinances that are more
stringent in their floodplain
management requirements. The
community may at any time enact
stricter requirements of its own, or
pursuant to policies established by other
Federal, State or regional entities. These
proposed elevations are used to meet
the floodplain management
requirements of the NFIP and are also
used to calculate the appropriate flood
insurance premium rates for new
buildings built after these elevations are
made final, and for the contents in these
buildings.

AGENCY:
SUMMARY: We, the U.S. Fish and
Wildlife Service (Service), announce a
90-day finding on a petition to list the
Monongahela River Basin population of
Catostomus catostomus (longnose
sucker) as endangered under the
Endangered Species Act of 1973, as
amended (Act). We find that the petition
does not present substantial scientific or
commercial information indicating that
listing C. catostomus may be warranted.
VerDate Aug<31>2005

Jkt 211001
This finding is based on our
determination that there is insufficient
evidence to indicate that the
Monongahela River Basin population of
C. catostomus represents a distinct
population segment (DPS) and,
therefore, it cannot be considered a
listable entity under section 3(15) of the
Act. Accordingly, we will not initiate a
status review in response to this
petition. However, the public may at
any time submit to us information
concerning whether the Monongahela
River Basin population of Catostomus
catostomus meets the DPS criteria for
this otherwise widespread species.
The finding announced in this
document was made on March 8, 2007.
DATES:
The complete file for this
finding is available for public
inspection, by appointment, during

Background
Section 4(b)(3)(A) of Act (16 U.S.C.
1531 et seq.) requires that we make a
finding on whether a petition to list,
delist, or reclassify a species presents
substantial scientific or commercial
information to indicate that the
petitioned action may be warranted. We
are to base this finding on information
provided in the petition, supporting
information submitted with the petition,
and information otherwise available in
our files at the time we make the
determination. To the maximum extent
practicable, we are to make this finding
within 90 days of our receipt of the
petition, and publish our notice of this
finding promptly in the Federal
Register.
Our standard for substantial
information within the Code of Federal
Regulations (CFR) with regard to a 90day petition finding is ‘‘that amount of
information that would lead a
reasonable person to believe that the
measure proposed in the petition may
be warranted’’ (50 CFR 424.14(b)). If we
find that substantial information was
presented, we are required to promptly
commence a review of the status of the
species.
In making this finding, we relied on
information provided by the petitioners
and otherwise available in our files at
the time of the petition review and
evaluated this information in
accordance with 50 CFR 424.14(b). Our
process of making a 90-day finding

BFEs modifications for the communities listed below. The BFEs are the
basis for the floodplain management measures that the community is
required either to adopt or to show evidence of being already in effect
in order to qualify or remain qualified for participation in the

Agency, 500 C Street, SW., Washington, DC 20472, (202) 646-3151.
SUPPLEMENTARY INFORMATION: The Federal Emergency Management Agency
(FEMA) proposes to make determinations of BFEs and modified BFEs for
each community listed below, in accordance with section 110 of the
Flood Disaster Protection Act of 1973, 42 U.S.C. 4104, and 44 CFR
67.4(a).
These proposed BFEs and modified BFEs, together with the floodplain
