Federal Register / Vol. 72, No. 35 / Thursday, February 22, 2007 / Notices
specific to each alternative during the
preparation of the EIS would have been
impracticable and inefficient in light of
the large number of alternatives located
across three states and crossing
numerous agency jurisdictional
boundaries.
Instead, DOE will work with USFWS,
National Oceanic and Atmospheric
Administration (NOAA) Fisheries, U.S.
Army Corps of Engineers, EPA, and
other Federal, state, and local natural
resource agencies to develop specific
mitigation measures for unavoidable
impacts to endangered species, EFH,
wetlands, and other resources, as
described in the final EIS. The
mitigation plan for the alternative
selected in this ROD will be developed
during the permitting process, after
wetland delineations and jurisdictional
determinations and a functional
assessment of affected wetlands is
completed. DOE will also complete a
formal consultation with USFWS and
NOAA Fisheries and prepare a
Biological Assessment as mandated
under Section 7 of the Endangered
Species Act for any endangered species
that may be affected by the selected
alternative. Through these activities,
DOE will develop and adopt a detailed
mitigation plan to take all practicable
means to avoid or minimize
environmental harm, as required by 40
CFR 1505.2(c).
Dated: February 14, 2007.
Samuel W. Bodman,
Secretary of Energy.
