One amendment provides MGE with the right to extend its Right of First Refusal at its existing negotiated rate. The other amendment extends MGE’s deadline to request additional capacity from ANR and provides that MGE is not required to rely solely on ANR for additional capacity. ANR requests that the Commission accept and approve the subject filing to be effective December 1, 2006. Brush Cogeneration Partners (Brush) filed an application for market-based rate authority, with an accompanying rate schedule. The proposed marketbased rate schedule provides for the sale of energy, capacity and ancillary services at market-based rates. Brush also requested waivers of various Commission regulations. In particular, Brush requested that the Commission grant blanket approval under 18 CFR part 34 of all future issuances of securities and assumptions of liability by Brush. On November 30, 2006, pursuant to delegated authority, the Director, Division of Tariffs and Market Development—West, granted the requests for blanket approval under part 34. The Director’s order also stated that the Commission would publish a separate notice in the Federal Register establishing a period of time for the filing of protests.
