and public procedure under 5 U.S.C.
553(b) are unnecessary.
Section 73.22 of Title 14 CFR part 73
was republished in FAA Order
7400.8M, dated January 6, 2006.
The FAA has determined that this
regulation only involves an established
body of technical regulations for which
frequent and routine amendments are
necessary to keep them operationally
current. Therefore, this regulation: (1) Is
not a ‘‘significant regulatory action’’
under Executive Order 12866; (2) is not
a ‘‘significant rule’’ under Department of
Transportation (DOT) Regulatory
Policies and Procedures (44 FR 11034;
February 26, 1979); and (3) does not
warrant preparation of a regulatory
evaluation as the anticipated impact is
so minimal. Since this is a routine
matter that will only affect air traffic
procedures and air navigation, it is
certified that this rule, when
promulgated, will not have a significant
economic impact on a substantial
number of small entities under the
criteria of the Regulatory Flexibility Act.
The FAA has determined that this
action qualifies for categorical exclusion
under the National Environmental
Policy Act in accordance with 311d.,
FAA Order 1050.1E, ‘‘Environmental
Impacts: Policies and Procedures’’. This
airspace action is not expected to cause
any potentially significant
environmental impacts, and no
extraordinary circumstances exist that

Notice of temporary deviation
from regulations.
ACTION:
SUMMARY: The Commander, Eighth
Coast Guard District, has issued a
temporary deviation from the regulation
governing the operation of the SR 46 (St.
Claude Avenue) bridge across the Inner
Harbor Navigation Canal, mile 0.5
(GIWW mile 6.2 East of Harvey Lock) in
New Orleans, Orleans Parish, Louisiana.
This deviation provides for the bridge to
remain closed to navigation for
approximately 11 consecutive hours to
conduct scheduled maintenance to the
drawbridge.
DATES: This deviation is effective from
6:30 a.m. until 5:45 p.m. on Tuesday,
December 5, 2006.

SUPPLEMENTARY INFORMATION: The Board
of Commissioners of the Port of New
Orleans has requested a temporary
deviation in order to replace the
riverside lower forward roller assembly
for the operating strut guide of the
bridge. These repairs are necessary for
the continued operation of the bridge.
This deviation allows the draw of the St.
Claude Avenue bascule bridge across
the Inner Harbor Navigation Canal, mile
