What Are the Administrative
Requirements for This Action?
For a complete discussion of all the
administrative requirements applicable
to this action, see the direct final rule in
the Rules and Regulations section of this
Federal Register.
The Regulatory Flexibility Act (RFA)
generally requires an agency to prepare
a regulatory flexibility analysis of any
rule subject to notice and comment
rulemaking requirements under the
Administrative Procedures Act or any
other stature unless the agency certifies
that the rule will not have a significant
impact on a substantial number of small
entities. Small entities include small
businesses, small government
organizations, and small government
jurisdictions.
For purposes of assessing the impacts
of today’s proposed rule on small
entities, small entity is defined as
follows:
(1) A small business in the regulated
industry that has a gross annual revenue
less than $6 million (this varies by
industry category, ranging up to $10.5
million for North American Industrial
Classification System (NAICS) code
562213 (VSMWC)), based on Small
Business Administration’s size
standards;
(2) A small governmental jurisdiction
that is a government of a city, county,
town, school district or special district
with a population of less than 50,000; or
(3) A small organization that is any
not-for-profit enterprise that is
independently owned and operated and
is not dominant in its field.

Any civic or religious organization using an OSWI unit as
defined in the regulations.

8134
Civic associations and fraternal associations.
After considering the economic
impact of today’s proposed rule on
small entities, I certify that this action
will not have a significant economic
impact on a substantial number of small
entities. This action does not propose
any changes to the final OSWI rule, in
which we determined that the final rule
would not have a significant economic
impact on a substantial number of small
entities.

In the
final rules section of this Federal
Register, EPA is approving the State’s
SIP submittal as a direct final rule
without prior proposal because the
Agency views this as a noncontroversial
submittal and anticipates no adverse
comments. A detailed rationale for the
approval is set forth in the direct final
rule. If no adverse comments are
received in response to this action rule,
no further activity is contemplated. If
EPA receives relevant adverse
comments, the direct final rule will be
withdrawn and all public comments
received will be addressed in a
subsequent final rule based on this
proposed rule. The EPA will not
institute a second comment period. Any
parties interested in commenting on this
action should do so at this time. Please
note that if EPA receives relevant
adverse comment on an amendment,
paragraph, or section of this rule and if
that provision may be severed from the
remainder of the rule, EPA may adopt
as final those provisions of the rule that
are not the subject of an adverse
comment.

What Are the Administrative Requirements for This Action?
For a complete discussion of all the administrative requirements
applicable to this action, see the direct final rule in the Rules and
Regulations section of this Federal Register.
The Regulatory Flexibility Act (RFA) generally requires an agency
to prepare a regulatory flexibility analysis of any rule subject to

the rule will not have a significant impact on a substantial number of

After considering the economic impact of today's proposed rule on
small entities, I certify that this action will not have a significant
economic impact on a substantial number of small entities. This action
does not propose any changes to the final OSWI rule, in which we
determined that the final rule would not have a significant economic
impact on a substantial number of small entities.
